Suffolk County Police last night arrested a man for Driving While Intoxicated under Leandra’s Law in North Babylon after responding to a 911 report of an intoxicated driver.
 
A 911 caller reported seeing an intoxicated man getting behind the wheel of a car with a child in the backseat in the parking lot of Denny’s, located at 1143 Deer Park Ave., at approximately 10:45 p.m. When First Precinct officers arrived, they found Juan A. Espinal operating a 2013 BMW with his 8-year-old stepson in the back seat.
 
Espinal, 37, of 523 Pecan St., Lindenhurst, was arrested and charged with Aggravated Driving While Intoxicated with a Child Passenger 15-Years-Old or Younger (Leandra’s Law), and Endangering the Welfare of a Child.
 
The child was released to a family member. There were no injuries.
 
Espinal will be held overnight at the First Precinct and is scheduled to be arraigned at First District Court in Central Islip on March 25.
 
 
A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
