Burn ban beginning at 4:00pm today. Some campfires are still permitted.

P R O C L A M A T IO N A N D O R D ER B A N N IN G O P E N B U R N IN G

W H E R E A S current w eather conditions, including w ind and a shortage of rainfall, have resulted in extrem ely dry and hazardous conditions for open burning in Brow n County; and
W H E R E A S said conditions have led to an increase in the incidence of w ildland fires in
B row n C ounty and are likely to continue to do so; and
W H E R E A S w eather forecasts at this tim e do not indicate the probability of rainfall sufficient to reduce the danger of w ildland fires; and
W H E R E A S the conditions are such as to constitute a local disaster em ergency creating a danger to the health and safety of the residents of B row n C ounty and the property located
therein; and
W H E R E A S Ind. Code § 10-14-3-29 perm its the declaration of a local disaster em ergency by the principal executive officer of a political subdivision, w hich declaration m ay be effective for a period of no m ore than seven
(7) days w ithout the consent of the governing board of the political subdivision; and
W H E R E A S, the B oard of C om m issioners of B row n C ounty voted unanim ously in an open m eeting on Septem ber 15, 2010, to authorize the President of the B oard to issue this proclam ation and order to be effective until conditions im prove, so as to w arrant its rescission by said President;

IT IS H E R E B Y P R O C L A IM E D A N D O R D E R E D that:
1. A ll open burning of any kind, including but not lim ited to conventional fuels such as w ood or other
com bustible m atter, is hereby im m ediately prohibited in B row n C ounty, Indiana, effective the date set forth below .
T he follow ing are excepted from the ban:
A . C am pfires and other recreational fires that are enclosed in a fire ring w ith a diam eter of no m ore than 32 inches and a height of at least 10 inches.
B . G rills fueled by charcoal briquettes, propane, or natural gas.
C . T he burning of debris, such as leaves, tim ber or vegetation, including debris that results from building construction activities only if it is burned in a container w ith at least three solid sides, w ith the rem aining open side to be covered by a screen w ith openings of no m ore than then one quarter
inch each.
D . T obacco sm oking products, item s and devices, provided that such m aterials are fully extinguished before disposal and are properly and safely disposed of.
2. Should conditions w arrant, this prohibition of open burning m ay be term inated by the authority im posing

it.



3. T his order m ay be enforced by any law enforcem ent officer or other person or agency authorized by

B row n C ounty O rdinance N os. 03-02-98-01 and 11-06-95-01.
4. N oncom pliance w ith this order m ay be subject to the sanctions contained in Ind. Code
§ 10-14-3-34 and B row n C ounty O rdinance N o. 03-02-98-01, and any other sanction provided by law .
5. T he A uditor of B row n C ounty Indiana shall:
a. m aintain a copy of this order in the O ffice of the A uditor and conspicuously post this notice in
all C ounty public office buildings;
b. send copies of this notice to T he B row n County D em ocrat for public dissem ination;
c. send copies of this order to all fire departm ents and law enforcem ent agencies located or operating in B row n C ounty, Indiana;
d. send a copy of this order to the D irector of the B row n C ounty E m ergency M anagem ent A gency;
e. send a copy of this order to all affected State offices, including B row n C ounty State Park,
Y ellow w ood State Forest, the Indiana State Fire M arshal, and Fire C ontrol H eadquarters of the
Indiana D epartm ent of N atural Resources; and
f. prom ptly file a copy of this order w ith the B row n County C lerk.
