San Clemente Residents
The City of San Clemente does not allow the use of ANY pyrotechnic fireworks within the city. Due to the high fire danger, San Clemente Police Services, in coordination with the Orange County Fire Authority, will be taking a zero tolerance approach to fireworks.
San Clemente Polices Services will be STRICTLY ENFORCING firework violations. A Fireworks Suppression Team with San Clemente / Hazardous Devices Squad Deputies will be assigned to specifically enforce firework violations.
The following are typical firework violations:
San Clemente Municipal Code Violations:
SCMC 8.16.160 (Article 78) – Possession and/or Use of Fireworks within city limits
** Safe & Sane Fireworks purchased in California are not allowed in San Clemente**
Health & Safety Code Violations:
H&S 12671 – Possession of Illegal Fireworks (Misdemeanor)
**Fireworks such as skyrockets and roman candles**
H&S 12677 – Possession of Dangerous Fireworks (Misdemeanor / Felony)
**Exploding Fireworks**
H&S 12689(a) – Providing Fireworks to a Minor (Misdemeanor)
California Penal Code Violations:
CPC 12303.2 – Possession of Destructive Device (Felony)
Mexican made M-80’s, M-100’s / Dry Ice bombs / Acid Bombs / Pipe Bombs
CPC 12303.3 – Exploding a Destructive Device (Felony)
Mexican made M-80’s, M-100’s / Dry Ice bombs / Acid Bombs / Pipe Bombs
All firework violations will be STRICTLY ENFORCED. These violations can result in either a citation for misdemeanor violations or arrest for felony violations.
