Suspect arrested following sexual battery incident (Case # JC 13-038)
On 01-22-13 at approximately 5pm, SRJC District Police Officers responded to the area of the Quinn Swim Center and 'C' Parking Lot for a report of a sexual battery that had just occurred. Arriving district police officers quickly identified a female victim along with a male suspect, who was being physically restrained by an SRJC staff member at the time.
Both the male suspect and the female were identified as SRJC students and upon being interviewed, gave virtually identical statements of how this incident took place. The female victim stated she was walking to her vehicle following her class in the area of the Quinn Swim Center when the male suspect walked up behind her. The male suspect, not known to the victim, grabbed the victim's buttocks in a sexual manner. The female immediately spun around and shouted at the male suspect. The male suspect reacted by striking the victim in the face with his open palm, resulting in red marks to the right side of her face. The male suspect then proceeded to run in a northern direction toward Burbank Auditorium where he was physically detained by a passing SRJC staff member who witnessed the female calling for help.
Subsequently, the male suspect was arrested for violations of California Penal Code Sections 243.4(e)(1) - Misdemeanor Sexual Battery, and 243.2(a)(1) - Battery on School Grounds. The male suspect was also admonished of his withdrawal of consent to be on SRJC District Properties for the next 14 days, pursuant to California Penal Code Section 626.4.
