In an on-going effort to serve the community in the most professional and responsive manner possible, the South Los Angeles Sheriff’s Station has initiated a social media based community outreach program entitled “Myth vs. Fact: The Law and You.”

The purpose of this program will be to provide weekly legal and/or sheriff’s department policy information to the community through the use of social media. The community will also be afforded the opportunity to e-mail questions directly to the station for discussion or clarification.

This week’s topic: Can a deputy sheriff enter my residence without a warrant?

Depending on the circumstances, the answer is yes. In accordance with long established legal precedent, there are (3) ways a peace officer can enter a residence without a warrant:

• By consent
• In order to conduct a parole/probation search
• As a result of an exigent circumstance

What constitutes an exigent circumstance? Generally speaking, anything that requires urgent and/or immediate law enforcement intervention such as the need to render aid to a seriously injured person, or stopping an assault, would qualify as an exigency.

Remember, If someone tells you a deputy cannot enter your home without a warrant, don’t be fooled by bad advice. Deputies are highly trained professionals who are well versed in all aspects of the law including the legal requirements associated with making a “warrantless” entry into a person’s home.
