New York State has increased DMV points to five (5) points for convictions of violations related to use of a cell phone and texting. 
The New York State Department of Motor Vehicles has amended the Commissioner's Regulation (15 NYCRR 131) to increase the number of points assessed for convictions of violations of Vehicle and Traffic Law (VTL) 1225-c involving use of a mobile telephone (i.e., cell phone) and VTL 1225-d involving use of an electronic portable device (i.e., texting device). The number of points has been increased from three (3) points to five (5) points.
This applies to violations committed on or after June 1, 2013.
