On March 25, 2014, at approximately 9:15 a.m., the Warsaw Police Department along with the Kosciusko County Major Crimes Unit, Indiana State Police, Mishawaka Police Department, St. Joseph County Police Department, and the FBI, in coordination with the Kosciusko County Prosecutor’s Office, and the United States District Attorney’s Office, simultaneously executed four search warrants and three arrest warrants in multiple jurisdictions following three months of investigation into billing irregularities between the City of Warsaw Public Works Department and Mishawaka based, ProForm Pipe Lining Co, Inc.
In December 2013, the City of Warsaw was made aware of possible intentional overcharging for various pipe lining projects and initiated an aggressive investigation at the direction of Mayor Joseph Thallemer. The investigation revealed eleven (11) billing discrepancies between May 2011 and May 2013 for an overcharge in excess of a quarter million dollars. The Indiana State Board of Accounts performed a simultaneous investigation.
The investigation, at this point, has identified three individuals believed to be involved in what appears to be allegations of conspiracy to defraud, dating back to 2010.
Today, search warrants to further the investigation into the individuals involved and the whereabouts of the funds received were executed at the following locations:

Additionally, arrest warrants were served on the following individuals with the subsequent charges pending for their participation in this racketeering activity:

Count VI – Providing False Information to Governmental Entity to Obtain Contract, a Class D felony
3. Lacy Francis, Jr. (59 years of age)
Former City of Warsaw Public Works Superintendent (resigned January 27, 2014)

Each of the above charged individuals is being held on $25,000 surety bond. The investigation is on-going.
