Citizen Advisory - July 4th Fireworks Guidelines

Last year, the City of Milan, as permitted by State Law, restricted the use of consumer fireworks to the day before, the day, of, and the day after a national holiday to the hours between 8:00 AM and 1:00 AM. Therefore, use of consumer fireworks between 1:00 AM and 8:00 AM the day before, the day of, and the day after a national holiday is a violation of City Code, and subjects a violator to a civil infraction, which carries a fine. Use of consumer grade fireworks at all other times than those permitted on the day before, the day of, and the day after a national holiday is still prohibited under both City Code and State Law. The city code regarding use of consumer fireworks (Article I, Section 8-2 (4)) is displayed below.

Ignition, discharge and use of consumer fireworks. It shall be unlawful for any person to ignite, discharge and use consumer fireworks at any time from any location in the City of Milan except between the hours of 8:00 a.m. and 1:00 a.m. on the day preceding, the day of, or the day after a national holiday.

The Milan City Code, which is consistent with Michigan State Law, defines display fireworks as follows:

Display fireworks means large fireworks devices that are explosive materials intended for use in fireworks displays and designed to produce visible or audible effects by combustion, deflagration, or detonation.

Display fireworks, are the large devices typically used in commercial fireworks displays. They remain illegal to sell, use, or possess in Michigan at all times without a specific permit pertaining to those devices.

On the City's website and Facebook page, there is an attachment from the Michigan Licensing and Regulatory Affairs website that is a good guide regarding the differences between the different classifications of legal fireworks in Michigan.

The City Code, under Section 8-1 Fireworks, provides additional guidelines involving the sale, use, and possession of the various types of fireworks.
