DA files murder charges against Brian Jones for his DUI that resulted in a double fatality.

FACTUAL INFORMATION:

On May 2, 2015, at approximately 6:51 PM, the Livermore Police Department responded to 975 Murrieta Boulevard for a report of a traffic collision involving a vehicle into a structure. The preliminary investigation revealed 35 year old Brian Jones was driving eastbound on Murrieta Boulevard and appeared to have lost control of his vehicle, striking a 40 year-old female and her 14 month old daughter, killing them instantly. The vehicle ultimately came to rest after striking the rear of the apartment complex at 975 Murrieta Boulevard.

Officers suspected Jones of driving under the influence of alcohol. At the scene, Jones submitted to a Preliminary Alcohol Screening test and the results were 0.13% and 0.14% BAC (Blood Alcohol Content). Jones was subsequently arrested for suspicion of Gross Vehicular Manslaughter While Intoxicated – a violation of 191.5 PC and Driving While Under the Influence of Alcohol Causing Injury – a violation of 23153 CVC. Jones was later released from custody after posting bail.

Today (May 21, 2015), Officers from the Livermore Police Department presented their DUI Fatal Collision investigation to the Alameda County District Attorney's Office regarding Brian Jones. After review of the criminal case, the Alameda County District Attorney's Office has filed the following formal charges against Brian Jones:

(2) Counts of 187 PC – Murder, and (2) Counts of 23153 CVC – DUI Causing Injury.

The Livermore Police Department would like to thank the community for their patience during this investigation. An investigation of this magnitude requires countless hours of continued investigation and follow-up, which includes interviewing multiple witnesses, writing search warrants, and collision reconstruction. The Livermore Police Department would also like to thank the Alameda County District Attorney’s Office and California Highway Patrol for their assistance in the investigation.

SUSPECT STATUS
Today (May 21,2015), Officers from the Livermore Police Department located Brian Jones in Fremont, CA and arrested him without incident. Jones was booked into the Alameda County Jail and he will be held without bail until his arraignment.
