9/29/15, Press Release: Disorderly Conduct
At approximately 10:24 this morning the Burlington Police responded to the report of a male seated on a step in the vicinity of South Winooski and Pearl Street. The caller advised the male appeared to be holding a pistol to his head while laughing in a, “maniacal” manner and simultaneously pulling the trigger. Officers quickly responded to the area only to discover the male had left on foot. Additional witnesses were able to advise the male’s direction of travel as well as their belief that the gun in question looked to be either a toy or an air soft gun. Officers were able to quickly locate a male matching the description, as provided by witnesses, and he was subsequently identified as Jeffrey M. Bragg. Mr. Bragg had an air soft gun tucked underneath his knit cap that he was wearing. Mr. Bragg was taken into custody without incident and will be arraigned on the charge of Disorderly Conduct.
• § 1026. Disorderly conduct
(a) A person is guilty of disorderly conduct if he or she, with intent to cause public inconvenience or annoyance, or recklessly creates a risk thereof:
(1) engages in fighting or in violent, tumultuous, or threatening behavior;
(2) makes unreasonable noise;
(3) in a public place, uses abusive or obscene language;
(4) without lawful authority, disturbs any lawful assembly or meeting of persons; or
(5) obstructs vehicular or pedestrian traffic.
(b) A person who is convicted of disorderly conduct shall be imprisoned for not more than 60 days or fined not more than $500.00, or both.
