11/21/15, press release - DUI #2/Criminal Driving License Suspended

On November 21, 2015 at approximately 1445 hours, the Burlington Police Department responded to the report of a motor vehicle crash on VT-127, north of the North Avenue exit. The accident required VT-127 to be temporally shut down.

Upon arrival officers located a green Ford Focus, bearing Vermont Registration GHD102, in a ditch off of the southbound lane of VT-127. Preliminary investigation determined the operator, identified as Nyanroor Madit DOB 05/16/1992, had crashed into the northbound lanes guardrail, hit the back of another vehicle, crossed the median, and finally came to rest in a ditch.

While on scene, it was determined Madit was under the influence of alcohol, and was also criminally suspended. Madit was transported to the University of Vermont Medical Center, where she was treated and released into custody of the Burlington Police Department.

Madit was also accompanied by her passenger, Rebecca Short DOB 11/11/1989, who was arrested for violating her curfew, set by her court ordered conditions.

It was determined through Madit’s criminal history, that she has been convicted of one prior DUI.

Madit was charged with DUI #2, and criminal driving license suspended. Madit was subsequently lodged at the Chittenden Regional Correctional Facility to await arraignment.

A person charged with their second DUI shall be fined not more than $1,500.00 or imprisoned not more than two years, or both. At least 200 hours of community service shall be performed, or 60 consecutive hours of the sentence of imprisonment shall be served and may not be suspended or deferred or served as a supervised sentence, except that credit for a sentence of imprisonment may be received for time served in a residential alcohol facility pursuant to sentence if the program is successfully completed.

A person charged with a criminally suspended license shall be imprisoned not more than two years or fined not more than $5,000.00, or both.

Madit was also ticketed for the basic rule, a $220.00 traffic ticket, as well as two points on her license.
