Hunterdon County Prosecutor Anthony P. Kearns, III, announced the indictment of Michael M. Downey, age 51, of Milford, NJ. On March 16, 2017, Mr. Downey was indicted by a Hunterdon County Grand Jury for Lewdness, a 4th degree crime.
According to Prosecutor Kearns, “Mr. Downey was arrested by the Flemington Boro Police Department on December 23, 2016, after they were notified of a suspicious person in a parked vehicle in the parking lot of the Reaville Avenue Shopping Plaza in Flemingtom Boro. Officers responded and observed Mr. Downey seated in his vehicle and masturbating. Mr. Downey also was summoned for having an open container of alcohol in the vehicle, consumption of alcohol in a vehicle and a suspended registration.”
Prosecutor Kearns added, “We will continue to be diligent in law enforcement to enforce the law and protect the quality of life in Hunterdon County.”
The filing of a criminal complaint is merely a step in the criminal justice process. The defendant is presumed innocent until the matter is resolved in a court of law.
