Bryan Police Investigate Fatality Accident

On Thursday March 22, 2018, the Traffic Safety Unit will be working on accident reconstruction for the fatality collision that occurred on March 11th in the 2900 block of East State Highway 21. The closure will start approximately at 9:00 am and may last up to 1:00 pm. The curbside eastbound lane between Bluebonnet and Nuches will be closed. The remaining lanes will be intermittently be shut down during this period. We are encouraging motorist to avoid this area during the timeframe listed.

On March 11, 2018 at 12:18 a.m., Officers responded to the 2900 block of East State Highway 21 (SH21) for a reported hit and run collision. A silver Nissan 4 door and a white Chevrolet SUV were both travelling east on SH21. The Chevrolet struck the Nissan from behind and fled the scene. Responding officers were able to locate the Chevrolet and the driver with information provided by witnesses.
Mayte Gaitan, a 23-year-old Bryan resident was the driver of the Nissan. She was transported to CHI St. Joseph’s Hospital and pronounced deceased.
Juan Hernandez, a 25-year-old Bryan resident was determined to be the driver of the Chevrolet. He was transported to CHI St. Joseph’s Hospital for evaluation, but was not injured.
During the investigation, officers determined Juan Hernandez was intoxicated and had fled the scene of a collision. He was arrested and charged with Intoxication Manslaughter and Fail to Stop and Render Aid.
Intoxication Manslaughter is a 2nd degree felony. Texas Penal Code Sec. 49.08.
Fail to Stop and Render Aid resulting in death is a 2nd degree felony. Texas Transportation Code 550.021.
