OSBI Special Agents Arrested Man For Killing His Son
The Delaware County Sheriff's Department received a call at 1:43 this morning in reference to a shooting at 18945 E. 420 Road, Jay. There, deputies discovered a 13-year-old boy dead inside a pickup truck from a gun shot wound. The sheriff's office called OSBI special agents to help with the homicide investigation. When agents arrived, they conducted numerous interviews and documented the crime scene. Agents arrested the victim's father and booked him into the Delaware County jail for first degree murder. The investigation has revealed neighbors living near a home that was supposed to be vacant saw vehicles driving up to it. The neighbors were suspicious of the activity. Those neighbors called the homeowner's parents who lived nearby. The homeowner's father, Tony Rutherford (d.o.b. 11/18/1970), drove to his older son's vacant house and witnessed someone driving his son's pickup truck. Rutherford gave chase and fired his rifle at the driver several times. The driver of that truck was Rutherford's 13-year-old son. The child was pronounced dead at the scene.
