San Leandro man arrested and charged for negligent discharge of firearm inside his home

On Saturday, August 25th, 2018, a San Leandro man was arrested at his home in the 100 block of Dutton Ave. for negligently discharging his firearm inside his apartment.
 
The incident occurred the evening prior, around 11:30 pm when 29-year-old Minh Huynh was inside his second story apartment handling his loaded firearm. Due to an unconfirmed reason, the gun fired causing the bullet to penetrate the floor and travel to his downstairs neighbor’s apartment.
 
The neighbor was unharmed and called San Leandro Police to report the shot and the damage to his ceiling. After officers arrived, they made contact with Huynh who stated the discharge of his firearm was an accident.
 
Officers were able to locate and retrieve the suspected firearm from Huynh, however, during their investigation officers also located several other firearms inside his apartment. A record check revealed that two of the weapons found were reported stolen. In addition, Huynh was found to be in possession of drugs packaged for sale, cash and drug paraphernalia.
 
Huynh was arrested and transported to Santa Rita Jail in Dublin. Today, the Alameda County District Attorney's Officer charged Huynh with 3 felony charges that include drug and firearm offenses.
 
"Negligent discharge of a firearm is a crime, even if done so accidentally," said San Leandro Police Lieutenant Isaac Benabou. "There are no second chances if someone's inattention seriously injures or kills a person. We are thankful in this case that no one was hurt. Firearms must be treated as loaded at all time and should never be handled outside an approved environment."
