Probationer Arrested After Reportedly Possessing Firearm

Incident Summary
 
On September 12, 2018, at approximately 9:25 PM, officers responded to the 200 block of Douglas Street for a report of multiple subjects in a parked vehicle with one of the subjects armed with an assault rifle.  Multiple officers responded to the area and located the vehicle still occupied by three male subjects.
 
Based on the report that the subjects were in possession of an assault rifle the officers ordered the subjects out of the vehicle at gun point.  Once the subjects were removed from the vehicle officers located what appeared to be a Heckler & Koch UMP Submachine Gun inside the vehicle.  However, upon closer examination it was determined to be a replica firearm.  The replica firearm had no markings that would otherwise distinguish it as being a replica firearm.
 
The officers conducted a records check of the subjects and learned that one of the subjects, later identified as Carlos Lopez-Suazo, was on active felony probation for an assault with a deadly weapon and a gang enhancement.  Lopez-Suazo’s probation terms required him to submit to warrantless search and seizure, not to possess weapons, not to possess marijuana, not to associate with gang members or wear gang clothing.
 
During a probation search of the Suazo-Lopez and the area he was located the vehicle uncovered suspected marijuana and gang clothing in violation of the terms of his probation.  Suazo-Lopez was placed under arrest for a violation of 1203.2 PC, violation of probation, and transported to Sonoma County Jail.  The two other involved subjects were released from the scene without any charges.
 
A photograph of the replica firearm and a real version have been included to show just how similar the two are.  The Petaluma Police Department responds to numerous reports of subjects armed with firearms.  Officers responding to reports of armed subjects with firearms treat those reported firearms as being real until they are able to verify otherwise. 
 
The Petaluma Police Department would like to encourage all community members to refrain from displaying, carrying, or transporting replica firearms when possible.  All replica firearms should be clearly marked or identifiable as a replica firearm.  The City of Petaluma Municipal Code 10.56.010 prohibits the discharge of BB, pellet, or Airsoft guns within the city limits.
