Vehicle: Gold 2004 Nissan Quest
On December 8, 2018, at 9:15 P.M., Milpitas Police officers responded to an armed robbery at Lucky Supermarket, located at 1350 S. Park Victoria Dr.
A man entered the store and attempted to steal a large amount of alcohol and was confronted by a store employee.
During the confrontation, the man pulled out a handgun, from his waistband, and threatened to shoot the employee. The employee retreated back into the store and saw the suspect enter a gold Nissan Quest, change his clothes, and then flee on foot. Responding officers saw the Nissan leaving the parking lot and conducted a high-risk vehicle stop. Several occupants were detained and a loaded Smith and Wesson .38 caliber handgun was located inside the vehicle. A records check revealed the handgun had been reported stolen out of the City of Las Vegas, NV.
A short time later, an officer saw a man matching the suspect’s description leaving a nearby restaurant. The man was later identified himself as Ezequiel Gutierrez, who was on Post Release Community Supervision (PRCS) for felony evading. A subsequent search of the restaurant’s bathroom revealed a handgun holster inside of a trash can that fit the stolen handgun. Gutierrez was also positively identified by witnesses and through store surveillance footage. Gutierrez was arrested and a found to be in possession methamphetamines and drug paraphernalia.
Gutierrez was booked in the Santa Clara County Main Jail for robbery, weapon violations, PRCS violation, possession of methamphetamine, and drug paraphernalia.
