On September 11, 2019, members of the Fairfield Police Department’s Special Operations Team executed a search warrant on the Smoke Shop N More business, located at 1306 W. Texas St. The search warrant was the result of a month-long criminal investigation that began after detectives received information the business was illegally selling tetrahydrocannabinol (THC) products as well as tobacco products to juveniles. After an undercover purchase of THC products was made and an enforcement stop conducted on juveniles who just purchased tobacco products, the search warrant was served on the business.
The search warrant resulted in the seizure of THC cartridges (for vape pens), butane hash oil (BHO), and over $14,000 in US currency. The owner of the business, a 39-year-old Fairfield resident and an additional 32-year-old Fairfield resident employee, were identified as suspects in this investigation.
As the medical and law enforcement professions continue to learn more about vaporizer pens, the more dangerous and deadlier the effects of these products become evident. Due to the passing of California Proposition 64 in November 2016, California law now legalizes the recreational use and possession of marijuana for any person ages 21 or older. However, a business owner can only sell marijuana if the business possesses a state and local license. Prop 64 also empowers counties and municipalities to restrict and/or ban the sale of THC products within their respective jurisdictions. The City of Fairfield does not allow for the sale of marijuana within our jurisdiction. Anyone caught selling any THC products without a license has committed a misdemeanor under the current California law, 11359(b) Health and Safety Code.
Criminal complaints have been forwarded to the Solano County District Attorney’s Office on the owner and employee for their involvement in the illegal sale of marijuana. Additional municipal code violations have been forwarded to the City of Fairfield for code enforcement and license violations.
