Report of gun shot leads to arrest of Oakland City man.

On November 2, 2019, at 3:17 p.m. Deputy Garrett Tuley was dispatched to the 10000 block of East 125 South to investigate a report of a gun shot being fired and a man waving a handgun. Upon arriving in the area Deputy Tuley with the assistance of Oakland City Police Chief Tim Gaines began an investigation into the incident. During the investigation Deputy Tuley and Chief Gaines were invited into the residence on the property where the incident took place. Upon trying to speak with 61-year-old Larry Banks of Oakland City he physically began to resist Deputy Tuley, Chief Gaines, and Deputy Loren Barchett. At that point Mr. Banks was taken into custody as officers retrieved the handgun and finished their investigation. At the conclusion of his investigation Deputy Tuley administered a portable breath test to Mr. Banks and he tested three times over the legal limit. At that point Mr. Banks was taken into custody and transported to the Gibson County Jail where he was charged with Criminal Recklessness with a Deadly Weapon and Resisting Law Enforcement. He remains in custody on a $750 bond.

All Criminal defendants are to be presumed innocent until, and unless proven guilty beyond a reasonable doubt in a court of law.
