Suspect previously arrested for Rape of elderly victim arrested in additional Rape case

On September 13, 2019, the Sebastopol Police Department sent out an advisory message indicating that Tirso De Jesus Guzman-Vivar, age 26 of Sebastopol, had been arrested and booked in the Sonoma County Jail on a charge of Rape against an elderly female victim.

Today, 11-16-19, investigators from the Sebastopol Police Department were able to name Guzman-Vivar as the suspect in an additional Rape that took place in June, 2019.

In that case, the victim, a 61 year old female, reported to police that a suspect, later identified as Guzman-Vivar, had been at her home as a guest. Victim reporting wanting to provide some assistance to Guzman-Vivar, a local transient. During that visit, Guzman-Vivar drugged the victim and subsequently had sexual intercourse with her multiple times.

Initially, Guzman-Vivar's identity could not be known, since he had provided the victim with a false name. However, physical evidence obtained during the sexual assault investigation, including DNA, confirmed a positive match to Guzman-Vivar. Sebastopol Police investigators learned of the DNA match on 11-15-19.

Guzman-Vivar's DNA had previously been collected and retained in the Department of Justice (DOJ) database due to his numerous prior felony convictions.

Additionally, several samples of beverage retained by the victim were in need of testing to determine whether any of them contained controlled substance, in order to prove that she had been drugged. On 11-15-19, Sebastopol Police investigators learned that one of the beverage samples, which had been offered to the victim by Guzman-Vivar during the sexual encounter, was tested and indicated to have trace amounts of GHB, also known as the "date rape drug."

As of 11-16-19, Guzman-Vivar remained in custody at the Sonoma County Jail on the previous Rape case involving the elderly victim. Sebastopol Police therefore sent booking paperwork to the jail, effectively arresting and booking Guzman-Vivar on this new case for a violation of 261(a)(3) PC, Rape of an intoxicated victim.

Guzman-Vivar remains in custody.
