Advisory

DISPUTE IN PARKADE

6/30/2020

On Monday evening at about 8pm, Fairfax Officers responded to a disturbance at the Parkade.  The caller reported a dispute between a person power washing markings in and around the Parkade and some peaceful protestors.  Officers contacted all parties in the dispute and mediated the argument.  The person power washing was asked by our officers to leave the area.  He later called our station stating he was receiving a number of threatening phone messages.   This person does not reside in Fairfax and we are not investigating the threats at this time as that crime, if established, did not occur in Fairfax.

This person was not associated with the town and had taken it upon himself to remove the markings.  A similar thing happened with a citizen a week or so ago who took it upon himself to do this same thing.

A side note to this to clarify some confusion based on public social media postings.  Many of the current markings within the Parkade occurred on Thursday 6/27/2020.  Our officers responded to the Parkade on that date as well, after a complaint was received of these new markings in the Parkade.  During that call, Officers located a person nearby who they identified as having done the markings with “erasable chalk paint”.  Officers documented the incident and took no action against this person.

This person’s act of removing the markings was not a crime.  We did, of course, respond to the call to diffuse an argument and keep the peace, allowing for all individuals to vocalize their first amendment rights.
