Felony OWI 4th Offense
The Middleton Police Department arrested 50-year-old Alvin Marshall of Middleton for Operating a Motor Vehicle While Intoxicated—Fourth Offense, a felony.
On Friday, September 25 at approximately 11:45pm a Middleton Police Officer saw Marshall speeding and weaving in and out of his lane on Allen Boulevard and Century Avenue. The car Marshall was driving was reported stolen earlier in the day.
Upon stopping Marshall, the officer saw that he had bloodshot eyes and open can of beer in the car. Marshall also admitted to the officer that he was “DUI.” After field sobriety testing, Marshall was arrested for Operating While Intoxicated.
Marshall provided a breath sample after his arrest. The reported value was .25. Because Marshall has three previous OWI convictions, he was restricted to a blood alcohol content of no higher than .02 while driving.
Marshall was booked into the Dane County Jail for OWI—4th Offense and Operating a Motor Vehicle without Owner’s Consent, both felonies. Marshall was also cited for Speeding, Open Intoxicants, and Operating with a Revoked Driver’s License.
The car Marshall was driving was returned to its owner.
