Zero Tolerance for Illegal Fireworks Violations

As we begin to emerge from the pandemic and rotate back to a normal lifestyle, we are all excited about celebrating Independence Day with family and friends this year. We want to remind everyone to celebrate safely and enjoy the holiday but refrain from using illegal fireworks.  Fireworks have resulted in brush fires, damaged homes, missing pets, and unnecessary injuries.
 
Our surrounding hills are extremely dry, and all fireworks pose a significant threat to the safety of our community.  
 
Illegally obtained fireworks and “Safe and Sane” fireworks purchased legally elsewhere are still illegal in the City of Morgan Hill. Morgan Hill Police and Fire have adopted a “zero tolerance” policy for illegal fireworks and will be actively patrolling on the 4th for violations. The use and or possession of illegal fireworks will be prosecuted to the fullest extent of the law.
 
Possession of fireworks is a misdemeanor and can carry fines of up to $5,000 and up to one year in the County jail.

In addition, ADMINISTRATIVE FINES WILL TRIPLE between July 1-7 and between December 30-January 2 each year.
 

  • 1st violation is $300
  • 2nd violation is $600
  • 3rd violation is $1,500

8.32.030 - Violation of this section is a misdemeanor
