(a)
Prohibited. No person or organization, shall possess, store, sell, offer to expose for sale, use discharge or cause to be discharged, ignited or otherwise set into action within the City any type of fireworks including the following fireworks as defined in W.S.A. § 167.10:
(1)
A fuseless device that is designed to produce audible or visible effects or audible and visible effects, and that contains less than one-quarter grain of explosive mixture.
(2)
A device that is designed primarily to burn pyrotechnic smoke-producing mixtures, at a controlled rate, and that produces audible or visible effects, or audible and visible effects.
(3)
A cylindrical fountain that consists of one or more tubes and that is classified by the Federal Department of Transportation as a Division 1.4 explosive, as defined in 49 CFR 173.50.
(4)
A cone fountain that is classified by the Federal Department of Transportation as a Division 1.4 explosive, as defined in 49 CFR 173.50.
(b)
Nonfireworks. Under this section, "fireworks" do not include toy caps, sparklers, toy snakes or confetti poppers.
(c)
Fireworks users permit. Fireworks user permits may be issued to individuals or civic organizations upon written application to the Common Council pursuant to Section 167.10(3). All fireworks user permit applications shall be reviewed by the Fire Chief. Any permits issued under this section shall include the requirement that the fireworks display be supervised by trained personnel certified in the safe handling of fireworks. The permits shall also require proof of liability insurance in an amount acceptable to the Common Council.
