Felony OWI 4th Offense
On July 8, 2021 at 1:38AM, an officer with the Middleton Police Department observed a vehicle traveling westbound on University Avenur near Cayuga Street. The officer performed a DOT records check on the registered owner which returned with the registered owner not having a valid driver’s license. After following the vehicle for a period of time, a traffic stop was initiated and the vehicle stopped.
The driver was identified as Courtney C. Smith, 35, of Sauk City. The Officer noted a strong odor of intoxicants coming from Smith’s breath and his speech was slurred.. Smith admitted to drinking two to three intoxicating beverages. The Officer also noted that Smith had an open container that smelled of intoxicants inside his vehicle in close proximity to him.
Following field sobriety testing, Smith was arrested for 4th offense operating a motor vehicle while intoxicated (OWI), a felony.. A blood draw search warrant was required. Smith has a .02 restriction related to his previous OWI offenses.
Smith was booked into the Dane County Jail for the felony OWI. He was also ticketed for operating while revoked.
