Kidnapping Investigation Update

On Wednesday, September 29, 2021, at about 5:10 p.m., an adult male suspect was reported to have violently pulled an adult female victim into his vehicle in the 300 block of Mowry Ave. Witnesses confronted the suspect; however, the suspect drove off with the victim. Witnesses advised that the two appeared to know one another. Patrol officers responded and began searching for the suspect vehicle. Detectives responded, taking over the investigation; they were able to identify the suspect as a well-known prolific offender, Marquice McClinton (35), out of Fremont. McClinton has numerous arrests for firearms possession, felony evading, resisting arrest, and possession of drugs. He also has a prior arrest for attempt homicide with a firearm and is currently on probation for felony evading. 

 

Detectives searched for McClinton throughout the night. This morning at about 12:15 a.m., detectives located the suspect vehicle and initiated a pursuit. A San Jose Police Department helicopter responded and provided air cover during the pursuit. Patrol officers were able to conduct a PIT maneuver of the suspect vehicle near Sundale Dr. and Fremont Blvd. McClinton was arrested after a short standoff. There were no injuries to community members, officers, or the suspect during this incident. 

 

Approximately one hour later, Detectives located the female victim who was unharmed. 

 

McClinton was booked at Santa Rita Jail on charges of kidnapping, felony domestic violence, false imprisonment, and felony evading. McClinton also had another warrant for felony evading at the time of this arrest. Detectives are also concluding an 08/15/21 investigation where McClinton fled from an enforcement stop by a patrol officer. During the 08/15/21 incident, McClinton discarded a replica firearm while driving a vehicle with stolen license plates.
