PUBLIC NOTICE OF ORDINANCE 184

ARTICLE III. - NOXIOUS WEEDS, GRASSES, AND OTHER VEGETATION

Sec. 14-57. - Definitions
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Noxious weeds includes Canada thistle (Cirsium arvense), Dodders (any species of Cuscuta), Mustards (charlock, black mustard, and Indian mustard, species of Brassica or Sinapis), Wild Carrot (Daucus carota), Bindweed (Convolvulus arvensis), Perennial Sowthistle (Sonchus arvensis), Hoary Alyssum (Berteroa incana), giant hogweed (Heracleum mantegazzianum), Ragweed (Ambrosia elatior l.), Poison Ivy (Rhus toxicodendron), Poison Oak, Poison Sumac (Toxicodendron vernix), and grasses or vegetation of any description exceeding a height of 12 inches, and any other plant, tree or shrub which, in the opinion of the village council, is regarded as a common nuisance. All the aforesaid noxious weeds, grasses and other vegetation exceeding a height of 12 inches, as set forth in this section, shall be deemed to be a public nuisance.

Sec. 14-59. - Landowner Duty
A landowner owning land in the village shall cut down or cause to be cut down and/or destroyed, all noxious weeds and grasses growing thereon to a depth of ten rods or the depth of the lot, whichever is less, before May 1 in each year, and shall continue to cut down or cause to be cut down and/or destroyed, all noxious weeds, grasses and other vegetation throughout the remainder of the growing season of each year.

Sec. 14-65. - Penalties
Any landowner or occupant of said land who refuses to destroy noxious weeds, grasses and other vegetation as hereinbefore provided, shall, in addition to the foregoing, be responsible for a civil infraction as a blight violation and subject to a civil fine as provided in section 1-7.
