Early this morning, while conducting a security check of the area, Newark Police were alerted of illegal firework use.  Responding officers arrived within two minutes of the call to the 36000 block of Spruce St. and made contact with a 35-year old male out of Newark.  The subject was ultimately arrested for possession of “dangerous” fireworks, possession of a controlled substance, being too inebriated to care for himself or others, and probation violation. He was booked at Santa Rita Jail.

As a reminder to the public, the Newark Police does not tolerate illegal firework usage in Newark. ONLY State Fire Marshal Approved “Safe & Sane” fireworks, bearing the official State Fire Marshal seal are allowed in Newark. All “Dangerous” fireworks are illegal per CA Health & Safety Code 12677. Anyone found to be in possession of or using illegal fireworks is subject to fine and/or arrest.

Additionally, this year the Newark City Council adopted an ordinance adding Chapter 7.24, Fireworks Social Host Ordinance to the Newark Municipal Code. The Fireworks Social Host Ordinance establishes strict liability for social hosts that allow the deployment of illegal fireworks on their property or at their hosted gatherings. The City of Newark is authorized to issue administrative citations of up to $1,000 PER violation.

Firework Social Host Ordinance FAQ:
"What does this mean?"
If you host a party OR people gather on your property and light illegal fireworks, you may be fined up to $1,000.

"What if I wasn't the person who lit the illegal firework?"
You, as the social gathering host or the property owner, are responsible for your guests or those on your property.

“Can I be cited more than once?"
Yes. You can be fined up to $1,000 PER violation.

“Can I celebrate the 4th of July all month long?”
 “Safe & Sane” firework use is only permitted in Newark from midnight June 30 to midnight July 4.
