ARRAIGNMENT/BAIL STATUS: All arrestees were arraigned in Amsterdam City Court in front of the Honorable Judge William J. Mycek. Diaz and Joseph were remanded to the Montgomery County Correctional Facility without bail. Manon was released on his own recognizance to reappear in court at a later date under the provisions of New York State’s bail reform.
INCIDENT NARRATIVE: Pursuant to an active and ongoing investigation into the sale of illegal narcotics occurring within the City of Amsterdam. The Amsterdam Police Department/ Montgomery County Regional SWAT team simultaneously executed two search warrants on Wednesday October 5th at 19 Putnam Street Apt. 1 and at 243 Locust Avenue.
At 243 Locust Avenue detectives located and arrested Anthony Diaz and Nayquan S. Joseph. During a search of the residence detectives located and seized a large quantity of cocaine and heroin along with a large quantity of packaging materials, cutting agent, and other paraphernalia associated with the trafficking of narcotics.
At 19 Putman Street Apt. 1 detectives located and arrested Jose J. Manon. Manon was the subject an arrest warrant for criminal sale of a controlled substance after selling a controlled substance to a police source during an active drug investigation. During a search of the residence detectives located a quantity of cocaine and heroin packaged for individual sale along with drug paraphernalia including a digital scale.
All subjects were transported to Amsterdam Police Headquarters where they were processed.
Jose J. Manon was charged with the following,
1. Criminal Sale of a Controlled Substance 3rd (B-Felony)
2. Criminal Possession of a Controlled Substance 3rd(B-Felony)
3. Criminal Possession of a Controlled Substance 5th (D- Felony)
4. Criminal Possession of a Weapon 4th (A- Misdemeanor)
5. Criminal Using Drug Paraphernalia 2nd (A- Misdemeanor)
Anthony Diaz was charged with the following,
1. Criminal Possession of a Controlled Substance 1st (A-I Felony)
2. Criminal Possession of a Controlled Substance 2nd (A-II Felony)
3. Criminal Using Drug Paraphernalia 2nd (A- Misdemeanor) 2 COUNTS
Nayquan S. Joseph was charged with the following,
1. Criminal Possession of a Controlled Substance 1st (A-I Felony)
2. Criminal Possession of a Controlled Substance 2nd (A-II Felony)
3. Criminal Using Drug Paraphernalia 2nd (A- Misdemeanor) 2 COUNTS
The Amsterdam Police Department was assisted by New York State Police, Montgomery County Sheriff’s Office and the Office of the Montgomery County District Attorney Lorraine Diamond. While there was probable cause for this arrest all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
