ARRAIGNMENT/BAIL STATUS: Hernandez was processed at Amsterdam Police Headquarters where he then was arraigned in front of the Honorable Lisa W. Lorman and remanded to the Montgomery County Correctional Facility on $10,000 cash bail.
INCIDENT NARRATIVE: On November 21stAmsterdam Police took a report of a larceny of a package from a residence on Park Street in the city. An Amsterdam patrol officer responded to the residencewhere they determined that a male suspect had walked up on to the front porch of the residence and stolen apackage which was delivered earlier that morning. Officers were able to secure surveillance footage of the crime from the surrounding area and a suspect was developed as Luis A. Hernandez of Amsterdam.
Also on November 21st Amsterdam Police were notified of another larceny that occurred on Storrie Street in the city. Amsterdam patrols responded and determined that a Christmas decoration of Santa Claus on a winter sleigh was taken off a front porch by a male suspect. Using surveillance footage from private residences and businesses a suspect was developed and identified to be Luis A. Hernandez.
On December 20th Amsterdam Police responded to a building on Division Street for a reported larceny of construction equipment and tools. Amsterdam Patrol officers responded to the area and through investigation and the use of surveillance footage in the area officers identified the suspect as Luis A. Hernandez.
On December 26th patrol officers responded to a residence on James Street for a service call. While on scene they learned that Luis A. Hernandez had been staying at the residence and while on scene officers observed what appeared to be a quantity of stolen merchandise inside the apartment. A short time later an officer observed Hernandez walking on Edward Street. Hernandez held three active bench warrants for failing to appear in Amsterdam City Court on prior pending cases.
Officers having knowledge of his warrants attempted to stop Hernandez who immediately fled on foot. Officers were able to take Hernandez into custody after a brief foot pursuit. He was then transported to Amsterdam Police headquarters for processing and held pending arraignment.
Amsterdam detectives and patrol officers responded back to the apartment Hernandez was staying at and seized a large quantity of stolen power tools and other miscellaneous stolen property. One of the recovered items was the stolen Christmas decoration of Santa Claus and sleigh. That item was on display on the roof of the apartment Hernandez was staying in. Through the investigation it was determined that the power tools and many of the other items were recently stolen from a local contractor on Reid Street in the city.
While there was probable cause for this arrest, all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
