Deputies Respond to a Loma Linda Apartment Where a Convicted Felon had Discharged a Firearm and Refused to Exit

DATE/TIME: January 28, 2023 / 12:17 p.m.

INCIDENT: PC 273A(A): Cruelty to a Child
                   PC 29800(A)(1): Felon in Possession of a Firearm
                   PC 246.3(A) Willful Discharge of a Firearm

LOCATION: 10700 block of Poplar Street, Loma Linda, CA

SUSPECT(S): Malachai Moten, 23-year-old resident of Loma Linda

VICTIM(S): Confidential-Juvenile
                      People of the State of California


SUMMARY: On Saturday, January 28, 2023, at approximately 12:17 p.m., deputies from the San Bernardino County Sheriff's Department's Central Station responded to the 10700 block of Poplar Street in the city of Loma Linda. The reporting party stated her ex-boyfriend was inside the apartment with a gun. 

When deputies arrived, they discovered the suspect, Malachai Moten, was still inside the apartment. The reporting party asked him to leave, but he refused. The reporting party left the apartment with their child. Through the course of the investigation, deputies learned Moten was a convicted felon. Moten was in possession of a firearm and had discharged the weapon into the floor. Deputies were able to establish telephone contact with Moten and he refused to safely exit the apartment. As a precaution, nearby apartments were evacuated. Personnel from the San Bernardino County Sheriff's Department's Specialized Enforcement Division (SED) were requested to assist with the call. When all attempts to have Moten surrender were exhausted, SED personnel made entry into the apartment. Moten was located inside and was taken into custody without further incident. Subsequent to Moten's arrest, a search warrant of the apartment was served which led to the discovery of a shotgun.

Moten was arrested and booked at Central Detention Center for the above stated charges in lieu of $250,000.00 bail.
