SMPD Arrests Felon for DUI and Firearm Charges
San Mateo, CA - On Tuesday, March 14, 2023 at approximately 2:05 a.m., a San Mateo Police Department officer drove northbound on Flores Street and observed a black Toyota traveling in the same direction. The Toyota did not have an operational license plate light, which was a violation of the California Vehicle Code. The Toyota continued driving northbound before turning east onto 25th Avenue. When the vehicle turned south onto South Delaware Street, SMPD conducted a traffic enforcement stop.
Upon contacting the driver, officers observed objective signs of intoxication. After conducting standardized filed sobriety tests on the driver, later identified as Saimone Nai, officers arrested Nai for driving under the influence. A records check revealed Nai as a convicted felon. Because Nai’s vehicle was stopped in the roadway and not a legal parking spot, officers conducted an inventory search of the vehicle prior to towing it from the roadway. During the search of the vehicle, officers observed a sling bag on the backseat. Officers located a firearm loaded with a magazine and an additional magazine inside the bag. Nai was booked into San Mateo County Jail for felon in possession of a firearm, carrying a concealed weapon in a vehicle, felon in possession of ammunition, carrying a loaded firearm in public, driving under the influence of alcohol, and driving under the influence with a blood alcohol content of .08% or more.
Driving while impaired is illegal, whether it is alcohol, prescription drugs, over-the-counter medications or marijuana, and there are so many ways to get home safely without driving. Not only is it dangerous and irresponsible, impaired driving causes too many senseless tragedies. Charges: Felon in possession of a firearm (29800(a)(1) PC), carrying a concealed weapon in a vehicle (25400(a)(1) PC), felon in possession of ammunition (30305(a)(1) PC), carrying a loaded firearm in public (25850(a) PC), driving under the influence of alcohol (23152(a) CVC), and driving under the influence with a blood alcohol content of .08% or more (23152(b) CVC)
