ARRAIGNMENT/BAIL STATUS: Kazala was arrested and processed at Amsterdam Police Headquarters. Kazala was released on an appearance ticket to be arraigned in Amsterdam City Court on a later date.
INCIDENT NARRATIVE:
The City of Amsterdam Police Department announces the arrest of two individuals in connection with the death of a 19 month-old child that occurred in the City of Amsterdam in October 2022.
On Sunday October 9th 2022 at approximately 10:30 p.m. the Amsterdam Police Department and Amsterdam Fire Department responded to a 911 medical call for a 19 month-old child not breathing. Upon arrival officers were able to determine that the child was breathing however the child was observed to be suffering unknown medical distress. The child was turned over to members of the Amsterdam Fire Department who transported the child via ambulance to St. Mary’s hospital in Amsterdam shortly thereafter the child was taken to Albany Medical Center for further treatment.
On Wednesday October 12, 2022 the child passed away at Albany Medical Center. It was determined that the child suffered non-accidental trauma ultimately leading to the child’s death.
On Tuesday April 11, 2023, Kristen L. Burke was arrested and charged with Manslaughter 2nd, Assault 2nd, Criminally Negligent Homicide and Endangering the Welfare of a Child. Burke was processed at Amsterdam Police headquarters and was thenarraigned in front of the Honorable Judge Lisa W. Lorman and remanded to the Montgomery County Correctional Facility. Bail was set at $75,000 cash or $150,000 bond.
On Thursday April 13, 2023, Christina A. Kazala was arrested and charged with Endangering the Welfare of a Child. Kazala was released on an appearance ticket to be arraigned in Amsterdam City Court on a later date.
Members of the Amsterdam Police Department Detective Bureau along with members of the New York State Police have been actively investigating this case since it occurred while being assisted by Montgomery County Child Protective Services and the Office of Montgomery County District Attorney Lorraine Diamond. The investigation is ongoing and no further details will be released at this time.
While there was probable cause for these arrests, all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
