The Move Over Law
New Jersey enacted its “Move Over” law in 2009 to help protect emergency vehicles, tow trucks, highway maintenance vehicles, and other emergency services vehicles stopped on the side of the roadway, conducting official business. These individuals work daily in a dangerous environment, and the Move Over law provides them a buffer between them and passing traffic.
The “Move Over” law requires that all motorists approaching a stationary emergency vehicle, tow truck, highway maintenance, or other emergency service vehicle that is displaying a flashing, blinking or alternating emergency light change to a non-adjacent lane if they can safely do so.
If a lane change is impossible, prohibited by law, or unsafe, the motorist must reduce the speed of their vehicle to a reasonable and proper speed that is lower than the posted speed limit, and be prepared to stop, if necessary.
By doing this, motorists can help keep emergency responders and other service workers safe.
