Firework Social Host Ordinance

Summer is here! Which means 4th of July is around the corner! As we look ahead to the festivities, remember that ONLY "Safe and Sane" fireworks are allowed in the City of Newark.  ALL "dangerous" fireworks are strictly prohibited.

In 2022 the Newark City Council adopted an ordinance adding Chapter 7.24, Fireworks Social Host Ordinance to the Newark Municipal Code.

As a friendly reminder, the FIREWORKS SOCIAL HOST ORDINANCE establishes strict liability for social hosts that allow the deployment of illegal fireworks on their property or at their hosted gatherings.

The City of Newark is authorized to issue administrative citations of up to $1,000 per violation

Fireworks Social Host Ordianace FAQ:
- "What does this mean?"
If you host a party OR people gather on your property and light illegal fireworks, you may be fined up to $1,000

-"What if I wasn't the person who lit the illegal firework?"
You, as the social gathering host or the property owner, are responsible for your guests or those on your property.

- “Can I be cited more than once?"
Yes. You can be fined up to $1,000 PER violation.

-"What is allowed?"
California fireworks law divide fireworks into two categories:
1. "Dangerous Fireworks"
2. "Safe & Sane" Fireworks.

ONLY State Fire Marshal-Approved "Safe & Sane" fireworks, bearing the seal are allowed in Newark.

ALL "Dangerous" fireworks are illegal per Newark Municipal Code 15.17.050 and CA Health & Safety Code 12677

Additionally, the only time when legal fireworks ("safe and sane") are permitted in Newark is from midnight on June 30th to midnight on July 4th.
