Fireworks Are Illegal in the City of Morgan Hill
With the celebration of Independence Day approaching, the City of Morgan Hill would like to remind the community to celebrate safely and enjoy the holiday without using illegal fireworks. Fireworks have resulted in brush fires, damaged homes, missing pets, and unnecessary injuries.
Our surrounding hills are extremely dry, and all fireworks pose a significant threat to the safety of our community. In addition to these hazards, the loud noises and flashing lights scare pets, and the explosions can harm citizens suffering from post-traumatic stress.
Illegally obtained fireworks and “Safe and Sane” fireworks purchased legally elsewhere are still illegal in the City of Morgan Hill. Morgan Hill Police and Fire have adopted a “zero tolerance” policy for illegal fireworks and will actively be patrolling for violations on and around the 4th of July holiday. The use and/or possession of illegal fireworks will be prosecuted to the fullest extent of the law.
Possession of fireworks is a misdemeanor and can carry fines of up to $5,000 and up to one year in the County jail.
In addition, administrative fines will triple between July 1st -7th and December 30th - January 2nd each year.
- 1st violation is $300
- 2nd violation is $600
- 3rd violation is $1,500

8.32.010 - Sale or possession of fireworks is prohibited.
8.32.030 - Violation of this section is a misdemeanor.
