4. CONSPIRACY IN THE 5TH DEGREE (A – MISDEMEANOR)
ARRAIGNMENT/BAIL STATUS: Garcia was processed at Amsterdam Police Headquarters where she was then arraigned in Amsterdam City Court and released on her own recognizance to appear at a later date.
INCIDENT NARRATIVE: In October 2023 Amsterdam Police took a complaint implicating an employee of the Market Street McDonald’s Restaurant of stealing money and falsifying business documents. After further investigation, it was determined that the suspect, Garcia, had stolen over $2300.00 in U.S. currency from the business and had falsified bank deposit slips. The investigation included the review of a two-month period where the business had audits revealing accounts that were short of funds. Surveillance footage showed the employee, Isalivette M. Serrano-Garcia, was concealing money in her personal belongings and falsifying bank deposits.
On November 9th, 2023, the investigating officer located Garcia who was taken into custody without incident. Garcia was then transported to Amsterdam Police headquarters for further interview. During the interview, Garcia ultimately confessed to stealing the money from the business and falsifying the bank deposit slips.
The Amsterdam Police Department was also assisted by the office of Montgomery County District Attorney Lorraine Diamond in this investigation.
While there was probable cause for this arrest, all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
