NAME AND CLASSIFICATION OF CHARGES (F/M/V):
- Unlawfully Dealing with a Child 2ND ( B- Misdemeanor)
ARRAIGNMENT/BAIL STATUS: The employee of the Inhale Smoke Shop who sold the vape to a minor was processed on scene and issued an appearance ticket returnable to the Amsterdam City Court at a later date.
INCIDENT NARRATIVE:
On November 29th members of the Amsterdam Police Department Detective Bureau conducted an underage alcohol and tobacco/vape enforcement detail with help from The Montgomery County Cares Coalition to verify compliance with state laws by businesses licensed to sell alcohol, tobacco, and vape products in the City of Amsterdam.
An undercover agent visited 11 businesses throughout the City of Amsterdam to attempt the purchase of alcohol and tobacco / vape products. A sale of a vape was made to the underage agent at the following store.
- Inhale Smoke Shop – 135 Division, City of Amsterdam
The other 10 businesses were found to be in compliance with New York State Law.
While there was probable cause for this arrest, all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
