ARRAIGNMENT/BAIL STATUS:  Kellogg was arraigned in Amsterdam City Court in front of the Honorable Judge Lisa W. Lorman and remanded to the Montgomery County Correctional Facility without bail.
 
INCIDENT NARRATIVE:  In the early morning hours of 01/01/2024 The Amsterdam Police Department took a call reporting shots fired near a residence located on Division Street in the west end of the city.  Amsterdam patrol officers responded along with sheriff’s deputies from the Montgomery County Sheriff’s Office. 
On their arrival they located several people outside of a residence engaged in an active dispute.  Patrols learned through interviews of the subjects on scene that a gun was possibly fired during the dispute.  After the initial investigation police dispersed the group and began canvassing the area for further evidence of the alleged shooting.  Amsterdam Police detectives were called into assist and along with assistance from patrol, they were successful in gathering additional evidence and witness accounts of the incident.  A search warrant was granted for the residence where the incident occurred and an arrest warrant was signed for the arrest of the resident Joseph Kellogg Jr.  The Montgomery County Regional SWAT team was activated to assist with the execution of the search warrant and arrest warrant.

At approximately 4:00 p.m. Kellogg was successfully taken into custody without incident outside his residence on Division Street.  Amsterdam Police detectives and investigators from the Montgomery County Sheriff’s office then conducted a search of the residence where a rifle and ammunition were recovered. 
 
Kellogg was transported to Amsterdam Police HQ where he was processed and arraigned in Amsterdam City Court on the above charges. 

The Amsterdam Police Department was assisted by the Montgomery County Sheriff’s Office and the Office of Montgomery County District Attorney Lorraine Diamond.  The investigation is ongoing and additional arrests are possible.
 
While there was probable cause for this arrest, all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
