Wilmington Police have arrested three men on gun charges.
On May 6, at approximately 4:24 p.m., members of the Uniformed Services Division were in the 2300 block of Jessup Street, when they conducted a motor vehicle stop for an equipment violation. Officers made contact with the driver – 34-year-old Denny Toston Sr., 24-year-old Nyhe Toston, and a 15-year-old male juvenile. At this time, Nyhe Toston and the 15-year-old male juvenile fled from the vehicle on foot. Following a brief foot pursuit both subjects were taken into custody without incident, and police recovered a loaded .40 caliber handgun. Subsequently, Denny Toston Sr. was taken into custody without further incident.
Denny Toston Sr. has been charged with the following offenses in addition to traffic violations:
- Possession of a Firearm or Ammunition by a Person Prohibited – Two Counts
- Carrying a Concealed Deadly Weapon
- Possession of a Large Capacity Magazine
He was arraigned in Justice of the Peace Court 11 and was committed to the Howard R. Young Correctional Institution on $10,250 cash-only bail.
Nyhe Toston has been charged with the following offenses:
- Possession of a Firearm or Ammunition by a Person Prohibited – Two Counts
- Carrying a Concealed Deadly Weapon
- Possession of a Large Capacity Magazine
- Resisting Arrest
He was arraigned in Justice of the Peace Court 11 and was released after posting $11,100 secured bail.
The 15-year-old male juvenile has been charged with the following offenses:
- Possession of a Firearm or Ammunition by a Person Prohibited – Two Counts
- Carrying a Concealed Deadly Weapon
- Possession of a Large Capacity Magazine
- Tampering with Physical Evidence
- Resisting Arrest
He was arraigned in Justice of the Peace Court 11 and was committed to the New Castle County Juvenile Detention Center on $10,000 cash-only bail.
