NOISE NUISANCE LEADS TO TWO ARRESTS

HOLLISTER, CA.– On May 25, 2024, at approximately 8:00 p.m., Hollister police officers were dispatched to a residence on the 2000 block of Cobalt Court for multiple complaints of noise nuisance. Police officers arrived and advised the responsible person to turn the music down and to move illegally parked vehicles, some completely blocking sidewalks or in the middle of the residential cul-de-sac. 
 
Officers later responded after another complaint and contacted the same responsible person outside the residence. The responsible person was told he was being cited for a noise nuisance violation and was being detained. The responsible person refused to identify himself and attempted to walk away from the officers and back to the residential property. Officers advised him repeatedly he was being detained and was not free to leave, he continued being uncooperative. Edgardo Alvarado (33) was subsequently arrested for delaying and obstructing an officer and was booked at the San Benito County Jail.   
 
Officers responded again after additional complaints made about the noise nuisance.  During this response officers attempted to contact a responsible person at the front door.  A man who answered door promptly closed it on the officers.  The remaining attendees were uncooperative, and officers were unable to contact any responsible person.
 
At this time no one had acted upon the first issued warning to move their vehicles. Therefore, officers began towing the illegally parked vehicles. When the partygoers noticed the tow trucks arriving, a large group exited the party and confronted the officers. One person advised she was the owner of a vehicle being towed, and asked permission to take a bag out of the car. Sergeant Theresa Aguilera agreed to allow her to retrieve a bag from the car. After retrieving her bag, and when only a few feet away from Sergeant Aguilera, the woman turned around saying obscenities to her, and violently threw a bundle of keys containing a key fob, key chains, a small pocketknife, and an air pod case directly at Sergeant Aguilera striking her throat. As the woman turned to walk away into the crowd, officers were able to apprehend her. During her arrest, the woman resisted by spitting on the officer’s face and kicked the officer in the knee causing injury. 
 
Yuliza Dominguez Alvarado (23) was medically cleared at the hospital prior to being booked at the San Benito County Jail for felony assault on an officer, battery on an officer, and resisting arrest charges. 
 
The Hollister Police Department would like to remind all residents of the City of Hollister ordinance 8.28.020 Noise Prohibited details the restrictions on loud parties/noises.  The reporting party can remain anonymous and the residence which the noise is coming from can be fined up to $1,000 upon the officer’s return after a warning. Understand there is no 10:00 p.m. ordinance and anyone’s peace can be disturbed at any time of the day by unreasonable noise.  To read the full ordinance view the attached link.
