DOJ secures four decades in prison for defendant in brutal jewelry store robbery and assault
A New Castle County judge has sentenced Calvin Ushery for multiple convictions stemming from the 2022 robbery at Solid Gold Jewelers and brutal assault of the then 67-year-old shop owner. On September 3, Ushery, 40, was declared a Habitual Offender and sentenced to 40 years in prison followed by probation for convictions of Robbery First Degree, Assault First Degree, and Possession of a Deadly Weapon During the Commission of a Felony in New Castle County Superior Court. This sentence follows an investigation into the September 2022 robbery and assault on the 100 Block of W 9th Street in Wilmington which drew widespread media attention.
“We all remember the devastation that was felt throughout our community in the wake of this horrible attack nearly two years ago. It is difficult to fathom the level of callous cruelty and violence this criminal displayed.” said Attorney General Kathy Jennings. “Nothing can undo the immense harm that the defendant carried out against the victim, his loved ones, and our community, but thanks to the hard work and dedication of our DOJ team and the Wilmington Police he will spend the next four decades paying the price. Our hearts continue to be with the victim and his family as they heal.”
“This case involved a particularly brutal and disturbing assault, and I am proud of the work of our police officers and investigators to identify the suspect and take him into custody,” said Chief Wilfredo Campos. “While this sentencing cannot reverse the harm caused to the victim and his family, we hope it brings them – and our community – a measure of comfort that this dangerous offender has been held accountable for his actions.”
On the morning of September 9, 2022, Calvin Ushery entered Solid Gold Jewelers on W 9th Street in downtown Wilmington and initiated a robbery which was caught on video surveillance. Ushery produced a gun from his waistband and pistol-whipped the shop owner three times, knocking him to the floor unconscious. He then climbed over the counter, stomped on the victim’s head several times and began smashing the display cabinets with a hammer and filling his backpack with jewelry. When he noticed the victim stirring during the course of the robbery, Ushery struck the victim’s head several more times, including blows with a hammer, before fleeing with the stolen jewelry. The victim was taken to Christiana Hospital where he was treated for for a week, spending four days in the intensive care unit before being discharged.
