Deputies Arrest Man Responsible for Multiple Retail Thefts, Making Him Eligible for New Prop 36 Charges/Enhancements

DATE/TIME: Sunday, December 22, 2024/ 12:13 P.M.   

INCIDENT: P.C. 487(A)- Grand Theft, P.C. 459- Burglary, P.C. 488- Petty Theft
 
LOCATION: 15655 Roy Rogers Drive, Victorville 

SUSPECT(S): Elmer Daniel Palencia Moreno, 26-year-old Resident of Hesperia


SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On Sunday, December 22, 2024, at approximately 12:13 p.m, Deputy J. Vasquez was dispatched to Home Depot, located at 15655 Roy Rogers Drive, for a male subject who was at the location and had stolen over $10,000 in merchandise from the business. Home Depot Asset Protection personnel recognized the male subject, who was identified as Elmer Daniel Palencia Moreno, from a previous theft at Home Depot in Apple Valley. Moreno was also identified as the suspect of two separate thefts at the Victorville location on December 2nd and December 19th, 2024. 

Elmer Daniel Palencia Moreno was arrested and booked at High Desert Detention Center in Adelanto, for P.C. 487(A)- Grand Theft, P.C. 459- Burglary, P.C. 488- Petty Theft, and two outstanding warrants.
