Traffic Stop Leads to Arrest for H&S-11395, a New Health & Safety Code Created by the Passage of Proposition 36

DATE/TIME: December 20, 2024 / 1:00 p.m.

INCIDENT: H.S. 11395 – Possession of a Controlled Substance With Two Prior Convictions 

LOCATION: State Hwy 189 and Waters Dr. Crestline, San Bernardino County

SUSPECT(S): Howard Shelton, 56-years-old, Resident of Crestline

VICTIM(S): State of California


SUMMARY: On November 5, 2024, California voters passed Proposition 36, titled "The Homelessness, Drug Addiction and Theft Reduction Act." The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction, and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On December 20, 2024, deputies conducted a traffic stop in the area of State Hwy 189 and Waters Drive in Crestline for a vehicle driver who failed to stop at a stop sign. During the traffic stop, Deputy Maestas contacted Howard Shelton. Shelton had an active warrant for his arrest. During a search of Shelton's property, Deputy Maestas located approximately one ounce of suspected methamphetamine and a glass pipe commonly used for smoking methamphetamine.

Due to several prior convictions for drug possession (HS 11377a), Shelton was arrested for drug possession with two previous convictions (HS 11395). Shelton was transported, and booked at Central Detention Center.
