Prop 36 Arrest in Corte Madera

Corte Madera, CA –December 20, 2024:  

On the evening of December 20th, 2024 around 9:30PM, Central Marin Police Authority patrol officers responded to a disturbance at a Corte Madera grocery store.  A store employee reported a man was screaming and making threats towards him.  It was also reported the man had possibly shoplifted items before leaving the store.  Officers arrived and contacted Garth Hendrick, a 48 year-old male from Dublin, CA.  Hendrick matched the description provided by the store employee and was detained during the police investigation.   

Officers interviewed store employees and witnesses about the possible crimes committed.  Police determined probable cause existed to arrest Hendrick for criminal threats and shoplifting.  Additionally, and based off of California’s recent passing and enactment of Proposition 36, officers examined Hendrick’s criminal history.  It was determined that Hendrick had prior theft-related convictions in California.  Prop 36 enacted a new law -666.1 of the California Penal Code.  This law is enforceable as an additional charge should an offender have prior theft convictions, and when that offender commits a theft related crime.   

Hendrick was booked into Marin County Jail for petty theft with priors, criminal threats, shoplifting, being a felon in possession of stun-gun, and for possessing illegal drugs and drug paraphernalia.
