SUMMARY: On November 5, 2024, California voters passed Proposition 36, “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reformed multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction, and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies can apply during arrests when appropriate. These new charges can carry enhanced sentencing and prevent offenders from being cited and released before their court appearance. The following is an arrest where Proposition 36 was applied:

San Bernardino County Sheriff’s Department deputies responded to a commercial burglary in progress at Lowe’s, located at 13251 Peyton Drive, on December 26, 2024, at approximately 3:23 p.m.

Lowe’s Loss Prevention staff observed two male suspects concealing merchandise valued at approximately $1,500. The suspects, later identified as Mustafa Mohammad and Kollion Green, exited the store and fled in a red SUV. Deputies located the vehicle nearby and conducted a traffic stop, detaining both individuals.

Through investigation, deputies confirmed the suspects entered the store intending to commit larcency. Both were arrested and booked for burglary with an enhancement for acting in concert with two or more persons.
