SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On Saturday, December 28, 2024, at approximately 12:54 a.m, Central Sheriff's Station's Deputy E. Gonzalez and Deputy M. Jimenez were assigned to the unincorporated areas of San Bernardino. Gonzalez conducted a bicycle stop on a rider who did not have any lighting equipment on his bicycle.
The rider, Oscar Marrufo, was found to be in possession of a white crystalline substance, suspected to be crystal methamphetamine. During a records check, Marrufo was found to have two prior convictions for drug related offenses. Marrufo was arrested for Health and Safety code 11395(c) - Possession of a Hard Drug Treatment Mandated Felony, in accordance with Proposition 36.
Marrufo was booked into the Central Detention Center Jail with a bail of $30,000.00.
