Convicted Felon Arrested after Arriving on Jail Property in Possession of Narcotics

SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On January 5, 2025, Deputy Martinez-Nava contacted Steve Canche, as he drove his vehicle past the guard station and onto the West Valley Detention Center property. A record check of Canche revealed he was a convicted felon. Per Penal Code 4571, Canche was not allowed to be on the property. Martinez-Nava conducted a search of Canche’s vehicle and located a glass pipe and approximately 2 grams of suspected methamphetamine. Canche’s multiple previous convictions for narcotics possession was a violation of H&S 11395, Possession with Two or More Prior Convictions.
Canche was arrested and booked into the West Valley Detention Center for H&S 11395, Possession of Narcotics with Two Prior Convictions, PC 4573.5, Bringing Narcotics onto Jail Property, and PC 4571, Convicted Felon on Jail Property.
