San Bernardino Man Arrested and Booked After Stealing from Local Grocery Store

INCIDENT: Petty Theft with Two Prior Convictions (Proposition 36)

SUMMARY:
On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On Tuesday, January 7, 2025, at approximately 10:53 AM, employees at Albertson's Supermarket alerted Sheriff's Dispatch regarding an ongoing petty theft. A male adult, identified as Useplatique Lacey, had stolen bottles of liquor from the store and the the store desired prosecution for the theft.
Deputies located Lacey across the street from the incident location and detained him without incident. A criminal records check revealed Lacey had more than two prior convictions of theft related crimes. Consequently, Lacey was arrested for the above charge and was booked at the Central Detention Center with a $30,000.00 bail.
