INCIDENT: Proposition 36, Heath and Safety Code 11395
LOCATION: Loma Avenue / Lynwood Drive, San Bernardino
SUSPECT(S): Manuel Lozano, 36-year-old resident of San Bernardino
VICTIM(S): State of California
SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On January 11, 2025, Deputy Strain from the Central Station observed Manuel Lozano violate multiple California Vehicle Codes (CVC) while operating his bicycle. Strain initiated a traffic stop and contacted Lozano. During the contact, Strain learned Lozano was on probation out of Los Angeles County, for drug related offenses.
Upon searching Lozano’s pockets, Strain located suspected methamphetamine. A records check revealed Lozano had multiple drug related arrests and convictions. Lozano was arrested and booked into the Central Detention Center for HS 11395 (b)(1), a felony in the State of California. Los Angeles County Probation was notified of Lozano's arrest.
